Creator Agreement

Effective 22 October 2026. This agreement is between you (the creator) and Dropwave SRL. You sign it in Creator Studio before publishing any persona, and it applies alongside the Terms of Service and the Content and Moderation Policy.

1. Who can be a creator

You must be 18 or older and the person, or the authorised representative of the business, named on the account. One person per account; you may not share or sell it.

2. Identity verification and records

Before you publish, you pass an identity check (government ID plus a live selfie) with our verification partner. We keep proof of your identity and age, and your signed agreement, for as long as the law requires and at least 7 years after your account closes. We may ask you to verify again, for example when your payout details change.

3. Personas

A persona is either you yourself ("Real creator") or an AI-generated character you create and control ("AI persona"). You choose which when you create it, and fans are shown it. An AI persona does not have to look like you or share your gender.
Unless you turn it off, an AI replies for your persona while you are offline, using your persona's brief and the phrases you add. Fans are told that replies may be AI-assisted, and your own messages are marked "Live". You are responsible for the phrases you add.
Every persona must be stated as, and look like, an adult of 18 or older. Nothing about a persona's name, look, bio, tags or chat may suggest a minor.
A persona may not use another real person's name, likeness or identity. A Real creator persona must show only you, the ID-verified account holder, and may link only social media accounts verified as yours.
You are responsible for the persona's profile, personality brief, first message and hard limits.

4. Images and media

AI personas: upload only AI-generated images that you have the right to use. No photos of real people and no deepfakes.
Real creator personas: photos and videos must show you. Anyone else shown must be an adult who gave written consent, and you must be able to prove their age, identity and consent on request.
Every image must depict adults only.
Tag every explicit image as explicit. Fans must pass an age check before they can see explicit content, so a wrong tag is a serious breach.
Every upload is checked automatically before it is published and may be reviewed by a moderator. We may reject or remove any of it.
You give Dropwave SRL a worldwide, non-exclusive licence to store, display and deliver your content inside SwipeSparks for as long as it is published, plus any period the law requires us to keep it.

5. AI replies and live chat

By default, AI generates your persona's replies using the personality brief you write. You can take over any chat and reply yourself; those messages are marked "Live" to the fan. You must not tell fans that AI replies were written by you or another person, ask fans for contact details or payment outside SwipeSparks, or arrange to meet a fan.

6. Earnings, fees and payouts

You earn the value of the credits fans spend on your personas: photo and video unlocks, tips and other paid features.
Platform fee: Dropwave SRL takes a platform fee of 10% of each sale. Payment processing fees are deducted from each sale. We will give you 30 days' notice of any change.
Referral offer: if you join through a Dropwave SRL referral link or code, you pay no platform fee on sales made before 1 January 2027 (00:00 Romanian time). After that, the standard platform fee applies.
Payouts run weekly once your balance passes $50 (500 credits), after a 14-day hold that covers chargebacks. You can be paid by bank transfer or crypto.
If a fan's payment is reversed, the matching earnings are reversed too.
We may hold earnings linked to suspected fraud or a breach under investigation, and tell you why.
You are responsible for your own taxes. We may ask for tax information before paying you.

7. Boosts

Boosts are paid promotion that ranks a persona higher for a set time and labels it "Boosted". A boost is not refundable once it starts, unless it failed to run.

8. Suspension and closing your account

We may remove content, pause personas, or suspend or close your account for breaking this agreement or our policies. We give you a written reason unless the law prevents it, and you can appeal as the Content and Moderation Policy describes. Legitimately earned balances are paid out after the hold, except where the law or a serious breach (such as fraud or illegal content) requires us to withhold them. You can close your account at any time.

9. Your relationship with us

You are an independent creator, not an employee or agent of Dropwave SRL. You are responsible for claims that arise from content you upload or write, and you agree to cover our reasonable costs if such a claim is brought against us.

10. Your privacy

Fans never see your identity. We share your identity details only with our verification and payment partners, and with authorities when the law requires it. The Privacy Policy explains how we handle your data.

11. Changes and law

We will give you 30 days' notice before material changes take effect. This agreement is governed by Romanian law, and disputes go to the competent courts in Romania.
